Overview
This Standard is about resolving water fittings enforcement cases that have been escalated to you.
It involves collecting information and reviewing the details of referred cases, reinspecting when necessary, establishing a plan for compliance, communicating with customers, managing conflict, drafting and having served contravention notices, and recording relevant details, including evidence of contraventions.
This Standard is for managers and senior water fittings compliance inspectors. In order to carry out this role, they must be experienced in the areas covered by the following standards:
- EUSWFRBE2 Inspect premises for water fittings compliance
- EUSWFRBE3 Educate, guide and enforce to secure water fittings compliance with legislation
- EUSWFRBE4 Provide information about water fittings for use in legal procedures
Performance criteria
You must be able to:
- collect and review information about referred cases from relevant sources
- make a critical assessment of actions and conclusions in referred cases against water fittings legislation and organisational enforcement policies and procedures
- seek any further required information, advice or support from relevant people, departments or organisations
- carry out reinspection's when they are required to obtain additional evidence to resolve cases
- develop a strategy for resolution which falls within organisational enforcement policies and procedures and which will ensure compliance with water fittings legislation
- use appropriate evidence, which clearly differentiates between fact and opinion, when explaining the results of your assessment to customers
- assess the risks which can be caused by contravention(s) and record the evidence in accordance with approved procedures and practices
- give clear information within a compliance plan about how to achieve compliance
- use language and behaviour that minimises conflict in line with organisational procedures
- safeguard against any aggressive and abusive behaviour in line with organisational procedures
- record accurate information about the detail and outcome of discussions and agreement reached with customers
- follow-up agreed compliance plans within agreed timescales and take relevant action following the outcome of re-inspections
- issue contravention notifications without delay and in accordance with approved procedures and practices
- record enforcement activities in organisational systems, highlighting and recording emerging trends in non-compliance issues
- suggest changes to systems and procedures that will avoid escalation in future cases
Knowledge and Understanding
You need to know and understand:
- relevant legislation appropriate to Northern Ireland, Scotland and England and Wales, covering the design, installation and maintenance of plumbing systems, water fittings and water-using appliances
- regulator specifications, appropriate British standards and approved installation methods including Type BA devices (reduced pressure zone valves) and what is required to be notified by customer prior to installation
- relevant regulatory, organisational, operational and emergency processes and procedures relating to health, safety and the environment
- what constitutes contravention of legislation for different plumbing systems
- the implications of non-compliance on public health including slight, significant and serious health hazard, financial impact, practicalities, logistics
- sources of information, advice or support for referred cases and how to communicate with them including customers, contractors, plumbers, inspectors, legal colleagues and official drinking water organisations
- procedures for planning and scheduling inspections
- the importance of making sure that customers understand the purpose of legislation and confirming, as far as practical, their understanding of the implications and of non-compliance
- how to secure compliance in a manner that maximises goodwill, co- operation and understanding of organisational policies and procedures
- how to recognise the main signs that a situation could lead to aggressive or abusive behaviour or risk to personal safety, how to adapt body language and communication for evolving situations and how to identify safe exit strategies
- different types of risk posed by different contraventions and the actions and penalties which can be applied
- what needs to be covered in the compliance plan including the rectifications for short term and permanent compliance
- how to determine acceptable timescales for follow-up activities
- information sources for the types of follow-up activities you may need to carry out including further investigations, re-inspection, providing documentation or information, receiving documentation or information
- recording requirements and the potential for its use as evidence where legal action is undertaken and how evidence is presented in court
- communication and negotiation techniques
- actions to take following re-inspections
- how to identify sources of information, their types and how to access them
- different types of risk posed by different contraventions and sanctions and the penalties which can be imposed
- what is involved in issuing compliance notifications and instigating enforcement procedures and when it is appropriate to do so
- the importance and methods of recording the evidence, and its use in legal proceedings
- organisational requirements for completion of contravention notifications
- who requires notice information
- enforcement procedures
- organisational and regulatory complaint procedures and any documentation required
