Overview
This Standard is about educating, guiding customers to comply with the legislation, and instigating enforcement procedures for non-compliance.
It involves explaining the implications of failing to comply, establishing a plan for compliance with follow-up actions, drafting and having served contravention notices, responding to customer questions and requests and recording relevant details, including evidence of contraventions.
This Standard is for water fittings compliance inspectors.
Performance criteria
You must be able to:
- explain the purpose of the legislation and its place in public health protection and check that customers understand it
- make clear and accurate statements to customers about the implications of failure to comply with the legislation
- provide accurate information about the coverage of legislation and actions which can be taken to ensure compliance
- explain that enforcement decisions are based on sufficient, relevant and accurate information, obtained within organisational policies and procedures
- agree a compliance plan and follow-up activities with customers, making sure they understand what needs to be done to achieve compliance
- record accurate information about the detail and outcome of discussions and agreement reached with customers
- follow-up compliance plans at the stated time and take relevant action following the outcome of re-inspections
- assess the risks which can be caused by contraventions and record the evidence in accordance with approved procedures and practices
- take immediate relevant action in line with organisational procedures when contravention of legislation constitutes a serious risk to water supply and public health
- issue contravention notifications without delay and in accordance with approved procedures and practices
- explain the validity of decisions to customers using appropriate evidence which clearly differentiates between fact and opinion
- report the detail of enforcement activities to relevant people in an appropriate format
- suggest changes to organisational systems and procedures that will improve them
- highlight emerging trends in non-compliance issues to relevant people
Knowledge and Understanding
You need to know and understand:
- relevant legislation appropriate to England, Wales, Northern Ireland and Scotland covering the design, installation and maintenance of plumbing systems, water fittings and water-using appliances
- regulator specifications, appropriate British standards and approved installation methods including Type BA devices (reduced pressure zone valves) and what is required to be notified by customer prior to installation
- relevant regulatory, organisational, operational and emergency processes and procedures relating to health, safety and the environment
- what constitutes contravention of legislation for different plumbing systems
- the importance of making sure that customers understand the purpose of legislation and their responsibility
- the implications of non-compliance on public health including slight, significant and serious health hazard, financial impact practicalities, logistics
- how to communicate with customers, contractors, plumbers, individuals, groups, and internal stakeholders.
- the importance of confirming, as far as practical, customer’s understanding of the implications of non-compliance
- how to carry out enforcement activity in a manner that maximises goodwill, co- operation and understanding of organisational policies and procedures
- different types of risk posed by different contraventions and the actions and escalations which can be applied and when they are appropriate
- what needs to be covered in the compliance plan including the rectifications for short term and permanent compliance
- how to determine acceptable timescales for follow-up activities
- information sources for the types of follow-up activities you may need to carry out including further investigations, re-inspection, providing documentation or information, receiving documentation or information
- recording requirements and the potential for its use as evidence where legal action is undertaken
- communication and negotiation techniques
- actions to take following re-inspections
- actions and organisational process when customers fail to cooperate and comply with the leglislation
- how to identify sources of information, their types and how to access them
- different types of risk posed by different contraventions and sanctions and the penalties which can be imposed
- what is involved in instigating enforcement procedures or confirming compliance and when it is appropriate to do so
- organisational procedures and escalation procedures for dealing with serious risk to water supply and public health
- different types of caution, when they are applicable, processes to follow so they are properly issued and their implications for prosecution processes
- the importance and methods of recording the evidence, and its use in legal proceedings
- organisational requirements for completion of contravention enforcement notice and who requires enforcement notice information
- enforcement procedures
- organisational and regulatory complaint procedures and documentation
